When it comes to hemp labels you may be a bit surprised at the repercussions of providing inaccurate information on them. There are many companies that are not truthful about the ingredients in their hemp products. Some may choose to take the risk but the FDA works diligently to monitor and hold companies responsible for not adhering to the stringent guidelines.

THC Content Factor

THC is the active ingredient in Marijuana that causes psychoactive effects in users. In order for hemp plants to be compliant under the FDA standards, they must not have any more than 0.3% THC content. Under the 2014 Farm Bill, hemp plants could not have any more than a 0.3% Delta-9 THC content, but the 2018 Farm Bill, which supersedes the 2014 Farm Bill, states that the whole THC content of the hemp plant, including the THC-A content, has to be under 0.3%. Because of this difference, the CBD companies must remain diligent in order to stay in compliance. THC-A, although it is THC does not have the psychoactive properties of Delta-9 THC because it has yet to be heated and transformed into Delta-9 THC. When you put a label on a hemp product, you have to be precise and accurate.

False Medical Claims

The FDA feels very strongly about medical claims that CBD companies put on their labels. For example, if a CBD company was to indicate on their labels that CBD will help with anxiety or pain, they could be cited for making false medical claims. There are many studies that have been conducted and a lot of anecdotal evidence but much more is needed to further substantiate before any claims can be made. Any brand making false promises should not be trusted.

When labeling a hemp product, do not make any medical claims or promises that your product can help with any medical issues.

Since CBD products are ingested and taken into and onto the body there are strict laws that regulate the statements that are provided on the label. Whenever you state the ingredients you have to be spot-on correct. You can’t leave anything out, and you can’t claim that there is something in there that isn’t. Although each state will have its own laws regarding the way ingredients are labeled and how they are accounted for in the list of ingredients, the Federal Government has the final say. The best way to label your ingredients is to research the topic and know the laws of your state.
